CONTAINER
SERVICES RULES, REGULATIONS AND RATES
ITEM
800
APPLICATION
SECTION-VIII of this Tariff provides rules, regulation and rates
for the receiving and handling loaded and empty marine containers.
Unless otherwise provided, in Section-VIII such activities will
also be governed by SECTIONS I, II, III, V, and VI of this tariff
to the extent applicable.
ITEM
801
TERMS AND DEFINITIONS
Terms and definitions applicable to SECTION-VIII include the following.
CHASSIS:
A wheeled assembly constructed to accept containers and equipped
with a device for coupling to a self-powered tractor for movement
over roads and highways.
CHECKING:
The service of matching cargo or containers against appropriate
documents for the account of the cargo, vessel or other person
requesting same.
COFC:
Container on a flatcar.
CONTAINER:
Any demountable marine container body constructed to International
Standards Organization (ISO) specification, capable of being handled
with standard container-top spreader gear. Standard dry cargo
closed containers, open tops, flat racks, platform, liquid and
temperature controlled containers are included in this definition.
CONTAINER
FREIGHT STATION (CFS): A facility where the stuffing or stripping
of containers is performed.
CONTAINER
TERMINAL: Any area specifically designated by the Port Authority
for receiving, storing or handling loaded or empty containers,
chassis and container cargo, prior or subsequent to movement by
water.
FREE
ITEM: The specified period of time allowed to a vessel for the
assembly of outward loaded or empty containers and chassis, or
the removal of inward loaded or empty containers and chassis from
the Terminal Facility without assessment of wharf demurrage or
terminal storage charges.
LOADING
AND UNLOADING: The service of loading or unloading (handling)
loaded or empty containers between any place in the terminal to
or from railcars and trucks.
POINT
OF REST: The area in the Terminal Facility assigned for the receipt
of inbound containers from a vessel and from which inbound containers
may be delivered to the consignee; and the area in the terminal
which may be assigned for the receipt of outbound cargo from shippers
for loading aboard a vessel.
STRIPPING
CONTAINERS: Unloading cargo from containers at a CFS
STUFFING
CONTAINERS: Loading cargo into containers at a CFS.
THROUGHPUT
CHARGE: The charge for handling a container within the Container
Terminal and includes movements necessary to complete delivery
to or from the stevedore, and to or from inland carrier, but does
not include transportation between Container Terminal yard and
vessel.
TOFC: Trailer on a flatcar
TOFC/COFC
RAMP POINT: The designated area within the terminal where loaded
or empty containers or trailers are handled to and from railcars.
TRAILER:
A vehicle constructed for the transport of cargo or freight from
point to point via highway with suitable permanently affixed undercarriage,
wheels and a device for coupling to self-powered tractor for movement
over roads and highways.

RULES AND REGULATIONS
1. Stevedoring rates, charges and services are not provided by
the Port Authority.
2.
Hours of receiving and delivering containers will be 8:00 a.m.
to 12:00 noon and 1:00 p.m. to 5:00 p.m., Monday through Friday.
Receipt or delivery of loaded or empty containers at other than
these times must be made by special arrangements through the Director
of Operations, telephone 361-882-5633.
3.
No vehicle may be driven, operated or parked, or caused to be
driven onto, operated or parked upon any Terminal Facility or
pier when, in the judgement of the Port Authority, such vehicle
would damage the wharf or pier, or operation of such vehicle would
interfere with the normal and safe operations of the Terminal
Facility.
4.
The rates, rules and regulations published herein DO NOT APPLY
to containers loaded in EXCESS of their capacity (OVERLOADS).
The Terminal Facilities of the Port Authority, including cranes,
lift machines, wharves, dock aprons and docks will not be used
to handle overloaded containers. Should any of the Terminal Facilities
be used to handle overloaded containers, the party or parties
causing such use are responsible for all losses, claims, demands
and suits for damages, including death and personal injury, and
including court costs and attorney's fees, incidental to or resulting
from such unauthorized use.
5.
Prior arrangements must be made with the Director of Operations,
telephone 361-882-5633, by authorized vessel agent, inland carrier,
the shipper, receiver or agent of the cargo interest for the following:
(a)
Containers exceeding 40 feet in length, unless such containers
are so constructed that they can be properly lifted and handled
with a 40 foot spreader;
(b)
Open type containers with loads which are over-dimensional (exceeding
any one of the outside length, width or height dimensions of a
standard dry 20' or 40' container) or overweight;
(c)
Any container with damage or other variances which impede normal
handling and movement.(Continued on next page)

THROUGHPUT CHARGES
Unless otherwise stated, charges apply per container:
1.
Loaded containers $54.00
2.
Empty containers $25.00
3.
Transshipped loaded containers $40.00
(Containers landed from a vessel and reloaded to a vessel without
being removed from the Container Terminal)
4.
Volume rates will be quoted on request.
ITEM
823
ADDITIONAL SERVICES
A charge for additional services, including extra handling, within
the Container Terminal will be assessed when performed at the
request of and for the convenience of the User or vessel as follows,
per container, unless otherwise stated.
1.
Inspection and interchange are not included in the rates stated
herein but will be quoted upon request.
2.
U. S. Customs, USDA, or other examination on carrier equipment,
including cost of resealing: $20.00
3.
Rehandling loaded or empty containers after initial location to
point of rest: $25.00
4.
Weighing of containers on wheels: $3.00
5.
Should a vessel, its agent, any shipper, receiver or other User
require a service not provided for herein, such service may be
performed at the option of the Port Authority subject to prior
arrangements which include charges for such service.
ITEM

WHARFAGE
All containerized cargo and empty containers moving through the
Terminal Facility will be assessed wharfage as follows.
LOADED
CONTAINERS - Wharfage will be assessed on the weight of the cargo
in loaded containers at the rates specified in Section-V herein.
All provisions of this tariff with respect to certification of
cargo weight for wharfage determination are applicable.
EMPTY
CONTAINERS - Wharfage of $1.00 per container will be assessed
on empty containers having an immediately prior or subsequent
movement by water and handled through the Terminal Facility.
TRANSSHIPPED
CONTAINERS - Wharfage will be assessed on the weight of the cargo
in loaded transshipped containers at the rates specified in Section-V
herein. Wharfage will be assessed one time only against the delivering
carrier on containers transshipped between vessels.

CERTIFIED WEIGHTS
EXPORT/OUTBOUND - All loaded containers and trailers arriving
for export or outbound movement by water must be accompanied by
a certified weight ticket. Loaded containers arriving without
a Certified Weight ticket will be weighed at the Container Terminal
prior to being received and charged $3.00 per container or trailer.
IMPORT/INBOUND
- The cargo weight on all loaded import/inbound containers and
trailers discharged from vessels shall be certified by the vessel
agent or its agent, as per Item 210 herein. Authority has the
right to weigh import containers and trailers for the purpose
of certifying weights. Containers weighed by the Container Terminal
will be charged $3.00 per container or trailer.

FREE TIME AND STORAGE
INBOUND CARGO - Loaded and empty containers on wheels or grounded,
will be allowed 15 days free time. Following expiration of free
time, storage charges will be charged as follows:

OUTBOUND CARGO - Loaded and empty containers on wheels or grounded,

LONG
TERM STORAGE - To encourage business through the Container Terminal
and as a convenience to ocean carriers and container leasing companies,
the Port Authority will make space available for the storage,
marshalling or pooling of containers and chassis equipment at
reduced rates subject to the following:
1.
Applies only for ocean carriers and their agents including feeder
services, and container and chassis leasing companies.
2.
The number of container and chassis equipment accorded storage
is subject to space available, and at the discretion of the Port
Authority. Storage is subject to prior arrangements with and confirmation
by the Port Authority.
3.
Sixty (60) days free time will be allowed. Upon expiration of
free time the following charges will be made:
